Arkay’s Art Cave operates arkaysartcave.com and provides the products, content, tattoo enquiry forms and other services available through this website.
These Terms of Service apply when you visit the website, submit information or purchase from Arkay’s Art Cave. By using the website, you agree to these Terms, our Privacy Policy, Shipping Policy and Return and Refund Policy.
If you do not agree with these Terms, please do not use the website.
USING OUR WEBSITE
You must be legally able to enter into a contract. If you are under 18, you should use this website or make a purchase only with the involvement of a parent or legal guardian.
You agree to provide accurate, current and complete information when placing an order, creating an account or submitting an enquiry.
You are responsible for protecting your account details and for activity conducted through your account.
PRODUCTS AND ARTWORK
We make every reasonable effort to display products, artwork, colours, dimensions and other details accurately.
Colours and appearance may vary slightly between screens and physical products. Minor variations that do not materially affect the product are not considered faults.
Products may be limited, discontinued or unavailable without notice. Product quantities may be restricted where reasonably necessary.
PREORDERS AND LIMITED RELEASES
Cave Drop products may be offered for a limited preorder period and produced according to the orders received.
Production and dispatch timeframes displayed on the website are estimates. We will communicate any significant delay or change affecting your order.
Requests to change or cancel a preorder must be made as soon as possible. Changes cannot be guaranteed once the preorder period has closed or production has begun.

ORDERS AND PAYMENT
Submitting an order is an offer to purchase from Arkay’s Art Cave. An order is accepted when payment has been successfully processed and an order confirmation has been issued.
We may decline or cancel an order for legitimate reasons, including product unavailability, an obvious pricing error, suspected fraud or an unavailable shipping destination. If we cancel a paid order, the affected amount will be refunded.
Please check your products, sizes, quantities, delivery address and contact details carefully before completing checkout.
All purchases are intended for personal use unless otherwise agreed in writing.
PRICES, TAXES AND IMPORT CHARGES
Unless stated otherwise, prices are displayed in New Zealand dollars and include GST where applicable.
Shipping charges are displayed during checkout.
International orders may attract customs duties, taxes or import fees charged by the destination country. These charges are the customer’s responsibility and are not included in the product price or shipping charge.

Delivery timeframes are estimates and may be affected by carriers, customs processing or events outside our reasonable control.
Where Arkay’s Art Cave arranges delivery, we remain responsible for the order until delivery as required by applicable consumer law. Please contact us if an order is damaged, significantly delayed or does not arrive.
Customers are responsible for providing an accurate delivery address. Additional costs resulting from an incorrect or incomplete address supplied by the customer may be charged where permitted by law.
RETURNS AND REFUNDS

Nothing in these Terms limits your rights under the New Zealand Consumer Guarantees Act 1993 or any other consumer law that applies to your purchase.
TATTOO ENQUIRIES
Submitting a tattoo enquiry form does not create a confirmed appointment or guarantee that a project will be accepted.
A tattoo booking is confirmed only after Arkay has accepted the project, agreed to an appointment date and received any required deposit.
Tattoo deposits, cancellations, rescheduling and appointment conditions are governed by the booking information provided before payment or confirmation.
INTELLECTUAL PROPERTY
Unless otherwise stated, all original artwork, tattoo designs, photographs, graphics, writing, branding, logos, videos and other content displayed through Arkay’s Art Cave belong to Arkay’s Art Cave or are used with permission.
Content may not be copied, reproduced, modified, distributed, sold, commercially used or presented as someone else’s work without prior written permission.
Artwork and website content may not be scraped, extracted, used to train artificial intelligence systems or used to create imitations or derivative commercial work without written permission.
Purchasing a physical product does not transfer copyright or reproduction rights to the purchaser.
PROHIBITED USE
You must not use the website:
• For any unlawful, fraudulent or harmful purpose
• To interfere with the website’s security or operation
• To transmit malicious code
• To collect another person’s information without permission
• To copy, scrape or commercially exploit website content

RELATIONSHIP WITH SHOPIFY
Arkay’s Art Cave is powered by Shopify, which provides the ecommerce platform used to operate this website and online store.
Any contract of sale made through the store is directly between the customer and Arkay’s Art Cave. Arkay’s Art Cave is responsible for the products and services it sells, order fulfilment and customer service.
